Purpose

A licensed chemical dependency treatment facility (CDTF) or a license applicant uses Form 3256 to apply for a temporary variance for a rule requirement in Texas Administrative Code Title 26 (26 TAC) Chapter 564, Standard of Care.

Procedure

When to Prepare

To request a temporary variance from complying with a provision of a rule in 26 TAC Chapter 564, a CDTF must submit Form 3256 and any supporting documents as required by 26 TAC Section 564.402.

Important Items to Note

HHSC cannot grant a variance for a statutory requirement per 26 TAC Section 564.402(d).
HHSC fully considers each variance request and will issue a formal response, which either grants or denies the request. HHSC will approve a granted variance for a specified period.
