The local intellectual and developmental disability authority (LIDDA) must conduct and document permanency planning for a person younger than 22 enrolling in, or currently residing in, an intermediate care facility for individuals with an intellectual disability or related conditions (ICF/IID), including a state supported living center (SSLC), or receiving Home and Community-based Services (HCS) Residential Support Services (RSS) or Supervised Living (SL) per 26 Texas Administrative Code, Chapter 330.11.

Note: Permanency planning is not required if the person is committed to an SSLC under Chapter 46B, Code of Criminal Procedure, or Chapter 55 Family Code

8100 Permanency Planning Instruments

The LIDDA must develop permanency plans using the permanency planning instruments located on Texas Health and Human Services webpage, Permanency Planning for Children, which includes:

8200 Enrollment Permanency Planning

For a person who is moving from a family-based setting and enrolling into an ICF/IID, SSLC or an HCS residential setting, the LIDDA must:

  • review the person’s records and, if possible, meet with the person before conducting permanency planning; 
  • hold a permanency planning meeting in person, by videoconference or by phone with the person, legally authorized representative (LAR), and if agreed to by the person or LAR, the provider and other important people in the person’s life;
  • complete Form 2260;  and
  • provide and review the A Message for Families, document with the person, LAR and the person’s actively involved family members.

If a person is between 18 and 21 years old, and does not have an LAR but does have an actively involved family member, include the family member in permanency planning unless the person is opposed.

If the initial permanency plan was not conducted at the time of enrollment, the LIDDA has 20 calendar days to complete it, from the first business day that the person appears on XPTR Report HC021395.W, Perm. Planning – Reviews Needed.

Note: If the person has a permanency plan for a previous enrollment, the LIDDA must complete an initial plan again for their enrollment into the current placement. The LIDDA that completed the enrollment into the residential setting is responsible for completing the plan, regardless of whether a LIDDA reassignment took place.

8300 Continued Permanency Planning

For a person who currently resides in an ICF/IID, including an SSLC or an HCS residential setting, the LIDDA must:

  • provide written or email notice to the LAR or, if applicable, the actively involved family member. The notice must:
    • state it is time to schedule a meeting to review the person’s permanency plan;
    • be sent no later than 21 days before the review due date; and
    • include a request for a response from the LAR or actively involved family member;
  • hold a permanency planning meeting with the person, the LAR, and if agreed to by the person or LAR, the provider and other important people in the person’s life;
  • update Form 2260 every six months – 183 days – after the initial review, continuing until the person reaches 22 years or transitions from the ICF/IID or HCS residential setting to live in a family-based setting; and
  • provide and review A Message for Families, document with the person, the LAR, and the person’s actively involved family member.

Any Permanency Plan recommendations that include continued placement in an institution after the initial six-month extension must be reviewed and approved by a secondary reviewer. Secondary reviewers must be a supervisor who has completed the permanency planning training as required by the LIDDA Performance Contract.

A new Permanency Plan Review is not required when a person moves between eligible settings, as long as the current plan on file is not due yet. However, the LIDDA must make sure the new residential provider has a copy of the current plan. 

8400 Permanency Planning Reports

The following Client Assignment and Registration (CARE) System XPTR reports are available on a weekly basis and are used to identify the people in need of permanency planning.

  • HC021395.W, Perm. Planning – Reviews Needed
    • This report identifies people due for permanency planning within the current month and upcoming month, as well as past due or never completed. 
  • HC021311.W, Perm. Planning – Reviews Not Approved
    • This report identifies reviews for people that require manual approval by HHSC. This could be if the person is younger than 10 or has no supports listed.
  • HC021393.W, Perm. Planning – Status by Person
    • This report identifies people assigned to the LIDDA’s catchment area who require permanency planning.

The LIDDA is responsible for running reports weekly and maintaining their own internal tracking to identify and complete all initial permanency plans and permanency plan reviews.

If an unfamiliar person appears on a LIDDA’s report, the LIDDA must research the person to determine the person’s residential setting and designated LIDDA. If the person belongs on another LIDDA’s report, the LIDDA whose report the person appeared on must alert the appropriate LIDDA and coordinate a change of county in CARE.

Note: If a person continues to appear on a LIDDA’s report without attempts to complete the plan or coordinate with the appropriate LIDDA, the person will be counted toward that LIDDA’s performance percentage.

8500 Submission Requirements

The LIDDA must submit a copy of Form 2260 to the ICF/IID or HCS provider, and LAR or family.

The LIDDA must enter into the CARE System screen 309, Permanency Planning Review/Add/Change/Delete:

  • the initial permanency planning information within 10 days after the date of the permanency planning meeting; and
  • the continued permanency planning review information within 10 days after the permanency planning review date.

Note: Plans for people younger than 10 require manual approval by HHSC. After entering CARE screen 309, the LIDDA must submit Form 2260 to HHSC via the approved method.
